Terms of Service

These Terms govern your use of the HitchPass application and website (the “Service”). Please read them carefully — they include important limitations on liability and, in Section 14, an agreement to resolve disputes through binding arbitration on an individual basis.

1.Acceptance

The Service is operated by HitchPass, a sole proprietorship operated by James Payne (“HitchPass,” “we,” “us,” or “our”). By creating an account, subscribing, or otherwise using the Service, you agree to these Terms of Service and to our Privacy Policy. If you do not agree, do not use the Service.

2.The Service

HitchPass is a mobile-first tool that helps RV travelers organize, track, and get more value from their campground membership networks — including storing membership details, surfacing perks, estimating payback, identifying coverage near a destination, and sending booking-window reminders. The Service is an independent organizational and informational tool. We are not affiliated with, endorsed by, or sponsored by any campground, membership network, or third-party provider whose information may appear in the Service.

3.Eligibility

You must be at least 18 years old and able to form a binding contract to use the Service. By using the Service you represent that you meet these requirements and that the information you provide is accurate.

4.Accounts

You are responsible for the accuracy of the information in your account, for keeping your login credentials secure, and for all activity that occurs under your account. Notify us promptly of any unauthorized use. We may suspend or close accounts that contain false information or that are used in violation of these Terms.

5.Subscriptions & Billing

The Service offers a free tier and paid subscription tiers. Paid plans are offered at $4.50/month billed annually ($54.00 per year) or $6.50/month billed monthly, plus any applicable taxes. Pricing is subject to change as described below.

Currency. All fees are stated and charged in U.S. dollars (USD), regardless of where you are located. If you pay from outside the United States, your bank or card issuer may apply currency conversion or foreign-transaction fees, which are your responsibility.

Automatic renewal — please read. Paid subscriptions automatically renew at the end of each billing period (monthly or annual, depending on the plan you choose) and your payment method on file will be charged the then-current price for the next period, until you cancel. By subscribing, you authorize these recurring charges. You may cancel at any time as described below; cancellation stops the next renewal but does not retroactively affect charges already made.

Payment processing. Payments are processed by our third-party payment processor, Stripe. We do not store your full payment card number. Your use of payment features is also subject to Stripe’s terms and privacy policy.

How to cancel. You can cancel your subscription at any time from your account settings within the Service, or by contacting us at supporthitchpass@gmail.com. Cancellation takes effect at the end of your current paid period, and you will retain access to paid features until that period ends. We do not require you to call or chat to cancel.

Renewal reminders. For annual subscriptions, we will send a reminder to your email on file before the plan renews, so you have the opportunity to cancel before the next charge.

Price changes. We may change subscription prices or plan features. If we increase the price of your plan, we will notify you by email before the change takes effect, and the new price will apply to your next renewal. Continuing your subscription after the effective date constitutes acceptance of the new price; if you do not agree, you may cancel before renewal.

Free tier. We may modify, limit, or discontinue features of the free tier at any time.

6.No Refunds

All subscription fees are non-refundable. Except where a refund is required by applicable law, we do not provide refunds or credits for any partial billing period, for unused time after cancellation, for features you did not use, or for periods during which your account remained open but inactive. When you cancel, you keep access through the end of the period you have already paid for. Our full Refund Policy is incorporated into these Terms.

8.Third-Party Networks & Content

The Service displays information about campground membership networks, campgrounds, discounts, perks, and other offerings that are owned and controlled by independent third parties. We do not control these third parties and we do not guarantee the accuracy, availability, pricing, terms, or continued existence of any membership, perk, discount, or campground shown in the Service. Availability of memberships, campgrounds, and perks varies by country and region, may differ from what is shown, and is not guaranteed in any particular location. Perks and availability can change or be withdrawn at any time at the discretion of the third party. Any dealings you have with a membership network or campground are solely between you and that third party, and we are not responsible for them. Estimated savings, payback figures, and similar outputs are informational projections only and are not guarantees.

9.Intellectual Property

The Service, including its software, design, text, graphics, and trademarks, is owned by HitchPass and protected by law. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use in accordance with these Terms. You retain ownership of the membership and account data you enter; you grant us a license to use that data as needed to operate and provide the Service.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any information, perk, or savings shown will be accurate or available. The Service is an organizational tool and does not constitute financial, travel, or professional advice.

11.Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HITCHPASS AND ITS OWNER WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR SAVINGS, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

12.Indemnification

You agree to indemnify and hold harmless HitchPass and its owner from any claims, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your misuse of the Service, your violation of these Terms, or your violation of any law or third-party right.

13.International Use

The Service is operated from the United States. We make the Service available to users in the United States and Canada; it may be accessible from other locations, but we make no representation that it is appropriate or available for use elsewhere, and you are responsible for complying with the laws of your own jurisdiction. The Service is not directed to residents of the European Economic Area, the United Kingdom, or Switzerland. If you access the Service from outside the United States, you understand and agree that your information will be transferred to and processed in the United States as described in our Privacy Policy.

14.Dispute Resolution & Arbitration

Please read this section carefully — it affects your legal rights.

You and HitchPass agree that any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration, rather than in court, except that either party may bring an individual claim in small-claims court if it qualifies. Arbitration will be administered by a recognized arbitration provider under its consumer rules, and judgment on the award may be entered in any court of competent jurisdiction.

Class action waiver. You and HitchPass agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding.

30-day opt-out. You may opt out of this arbitration agreement by emailing supporthitchpass@gmail.com within 30 days of first accepting these Terms, stating your name and that you wish to opt out of arbitration. Opting out does not affect any other part of these Terms.

Where prohibited by law. If binding arbitration or class-action waivers are prohibited or unenforceable under the consumer-protection law that applies to you — for example, residents of Quebec, Canada — then this Section 14 does not apply to you to the extent prohibited, and disputes will instead proceed in the courts permitted by your local law.

15.Governing Law

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Subject to Section 14, any dispute not subject to arbitration will be brought exclusively in the state or federal courts located in Texas, and you consent to their jurisdiction. Nothing in these Terms limits any non-waivable rights you may have under the consumer-protection laws of your state, province, or country of residence.

16.Termination

You may stop using the Service and cancel your subscription at any time. We may suspend or terminate your access to the Service, with or without notice, if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination (including Sections 6, 8–15) will survive.

17.Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date and, where appropriate, notify you by email or within the Service. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
